01General information only: no professional advice

Articles, guides, glossaries, cost guides, comparisons, calculators, FAQs and videos on this website are general information about outdoor projects in Northern Virginia. They are not engineering, architectural, surveying, legal, insurance, tax, financial or HOA advice, and they are not a substitute for a site visit or a written Contract.

• Structural decisions, such as retaining walls over about three feet, deck framing and footings, or work near slopes and foundations, may require a licensed professional engineer and a permit. Requirements vary by county, city and site.
• Permit, setback, HOA, burn-ban and fire-feature rules change and vary by jurisdiction. Confirm them with the authority for your address.
• Drainage and soil information is general. Every property's grading, soils and groundwater are different.
• Insurance coverage decisions are made by your insurer. We do not advise on coverage.

02Prices, cost guides and estimates

Prices, ranges and "starting at" figures on the website are illustrative, based on typical projects at the time they were written, and may change at any time. They are not quotes or offers. Your price depends on your site, design, materials, access and conditions, and is set only in a written estimate or Contract.

03Hidden and concealed conditions

Outdoor construction involves conditions that cannot be seen before work begins. Unless your Contract expressly includes them, myYardPros is not responsible for the cost of addressing, or delays caused by, concealed or unforeseeable conditions, including:

• buried rock, ledge, concrete, construction debris, old footings, tanks or foundations;
• stumps, root systems and buried organic material;
• unmarked or private utilities, irrigation lines, lighting wire, pet fences, septic components and wells;
• expansive clay, fill soils, unstable or saturated ground and high groundwater;
• rotted, undersized or improperly built framing, ledgers or flashing behind siding or decking;
• defects in work by previous owners or contractors; and
• hazardous materials, which we do not handle or remove.

When we find such a condition, we stop the affected work, explain the options and proceed only by written change order, as described in Section 5 of our Terms of Service.

04Results that depend on nature and care

• Drainage and water management: drainage systems are designed to manage expected runoff and groundwater. We cannot guarantee that no water will ever collect during extreme storms, rapid snowmelt, rising water tables or events beyond reasonable design conditions, or that work on your property will correct water coming from neighboring properties or public land.
• Lawns, sod, seed and plants: living materials depend on watering, weather, soil, sun, pests and care after installation. Germination, establishment and survival are not guaranteed unless your Contract includes a written plant or sod guarantee.
• Hardscape and natural materials: pavers, stone and concrete can show efflorescence, minor color variation and hairline cracking. Northern Virginia freeze-thaw cycles can cause minor movement. These are characteristics of the materials and climate, not defects.
• Wood: wood decking, framing and fencing can check, crack, cup, warp, shrink and weather. Stains and sealers wear and need maintenance.
• Exterior cleaning: pressure and soft washing cannot repair pre-existing damage and may reveal it, such as failing paint or caulk, oxidation, etching, loose mortar, worn sealers, leaking windows and seals, or permanent staining. Results on aged or damaged surfaces vary. We take reasonable precautions with plants and surroundings when using cleaning solutions.
• Before-and-after photos and case studies show real projects, but every property is different and your results may differ.

05Third-party materials and manufacturer warranties

Many products we install are made by third parties, including composite and PVC decking, pavers and wall block, natural stone, lighting fixtures and transformers, irrigation controllers and valves, artificial turf, sealers and stains. Those products are covered only by their manufacturers' warranties, which we pass through to you. myYardPros does not warrant manufactured products beyond our own workmanship, is not responsible for manufacturing defects or discontinued products, and does not guarantee that a manufacturer will honor its warranty. Product descriptions, specifications and images on our website come from manufacturers or are illustrative and may change.

Links to manufacturers, government agencies and other websites are provided for convenience. We do not control, endorse or take responsibility for their content, products or practices.

06Website provided “as is”

The website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We work to keep the website accurate and current, but it may contain errors, outdated information or interruptions, and we may change or remove content at any time without notice. Features that estimate your location, service area, travel distance or availability are approximations. We do not guarantee that the website will be secure or free of viruses, and you are responsible for protecting your own devices.

07Limitation of liability

To the fullest extent permitted by Virginia law:

• Website. myYardPros LLC, its members, employees and agents are not liable for any damages arising from your use of, or inability to use, the website or its content, including reliance on information it contains.
• Services. Our total liability for any claim arising from an estimate, Contract or services is limited to the amount you actually paid us for the specific work that gave rise to the claim.
• No indirect damages. Neither party is liable for indirect, incidental, special, consequential, exemplary or punitive damages, including loss of use, loss of enjoyment, lost profits or diminished property value, even if advised of the possibility.

These limits do not apply to liability for personal injury or death caused by negligence, to gross negligence, willful misconduct or fraud, to amounts payable under the Contract, or to any liability that cannot be limited under applicable law, including the Virginia Consumer Protection Act. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

08Indemnification

Website. You agree to defend, indemnify and hold harmless myYardPros LLC and its members, employees and agents from claims, losses and expenses, including reasonable attorney's fees, arising from your misuse of the website, your violation of our Terms of Service, or content you submit that infringes someone else's rights or is unlawful.

Services. To the extent permitted by law, you agree to indemnify myYardPros against claims, losses and expenses arising from (a) inaccurate information you provide about property lines, easements, private utilities, HOA approvals or site conditions; (b) work performed on the project by you or by contractors you hire directly; and (c) your failure to obtain approvals that are your responsibility under the Contract. myYardPros agrees to indemnify you, to the extent permitted by law, against third-party claims for bodily injury or property damage to the extent caused by our negligence or willful misconduct in performing the work. Each party's indemnity is reduced in proportion to the other's fault.

09Offers, testimonials and availability

Discounts and promotions, including the Heroes Discount, are subject to the terms stated with the offer, may change or end at any time, cannot be combined unless stated, and must be requested before you accept an estimate. Testimonials and reviews reflect individual customers' experiences. Service areas, scheduling and availability are subject to change.
